A few things hint that this is a murder and not suicide.
The gun is in the right hand and the blood has splattered on the wall on the right side.
The victim was clearly sitting and writing at the desk and also smoking at the time they were shot. If it would have been a suicide, the person would most likely have finished the cigarette before killing their self.
